"My long association with David Wilks began way back in the 1970's when my lovely wife and I settled into a new home in Northern Virginia while I was still an Army officer. Believing it was time to pay attention to professional estate planning, and armed with the name of a lawyer provided by a friend, we met with David Wilks. At that initial meeting he made us feel comfortable that he would provide the best possible estate planning. After completing our wills and living trusts he kept his word to keep us informed of legal changes by periodically asking us to see him.

About 5 years ago my dear wife passed away and I relied upon David to settle her estate. Over the years David became aware that I had two very loving sons and that due to my age and inability to get around without a walker I relied on them to assist me. He briefed my sons on the procedures that they could assist me with using "power of attorney." I appreciated the delicate manner he showed toward my sons, realizing they were grieving for the loss of a mother they loved dearly. David has always shown that he cares about me and my entire family.

David followed up after an appropriate period by providing me with a new estate plan. Based on David's legal expertise and his show of caring for clients I would recommend him without any hesitation. In my estimation David Wilks is an outstanding lawyer, and a very decent human being."

Over the last 30+ years, I’ve formed 4000+ individual estates with values ranging from $15,000 to $10,000,000+. Some of my clientele include the wife of an NBA player, and numerous high-level business executives and entrepreneurs.

I can help you:

✔️Avoid Accidental Disinheritance (surprisingly common) - Every single day, people accidentally disinherit their children, leaving behind a trail of shock, anger and confusion.

✔️Keep “Uncle Sam” Out of Your Pocket - Poor estate planning can result in an unexpectedly high tax burden. In some cases, heirs might be forced to sell the assets they inherit, like family homes or businesses, just to pay a tax bill.

✔️Protect Your Family - It’s difficult enough to grieve the loss of a loved one, without losing financial security as well. I can ensure your family is provided for, even when you’re no longer around.

✔️Ensure Smooth Transition of Your Business - If you want the business to keep operating smoothly in the event you become incapacitated or pass away, then there are at least 6 things you must have in your Estate Plan. Quick tip: Never put your business in your will.

✔️Prevent Stolen Assets - Not many people are aware of the loopholes that allow opportunists to take what belongs to your family after you’re gone. One small mistake is all it takes. Let’s make sure your Estate Plan is airtight.

✔️Scan For Unintended Beneficiaries - Another common shock is when assets meant for family members are sent to an ex-spouse or other unintentional beneficiary. It happens more often than you may think.

Not Sure if You Need an Estate Planning Attorney?

As both an Estate Planning and Probate Attorney, I’ve unfortunately witnessed tragic scenarios on a weekly basis for the last 30+ years.

In many cases, clients needing a probate lawyer are only in that situation because of the poorly executed or outdated Estate Plans of the Decedent.

I’ve been doing this for more than 30 years, which means I’m able to see areas of concern you may not know about. That’s why it’s never a bad idea to at least seek the opinion of an experienced attorney.

That way, you can make an informed decision now, before it’s too late.

Keep in mind.. If you pass without an estate plan, the state will decide what to do with your assets. Yikes. If that’s not what you want, give our office a call asap and let’s make sure that doesn’t happen.

DIY Estate Planning Templates

Over the years, I’ve been asked why I don’t offer DIY Estate Planning templates for sale. With my reputation in the industry and widespread reach, it would certainly be a lucrative source of passive income, requiring none of my personal time as customers simply fill in the blanks for themselves.

As tempting as that is, I witness too many disasters on a daily basis caused by using DIY Estate Planning Templates.

The stakes are too high, and probate law is too complex to risk a family’s future on a “one size fits all” template.

Every situation is unique, and requires a thorough review and customized plan to guarantee protection.

Frequently Asked Questions

What is Estate Planning and Why is it Important?

Proper Estate planning involves not only making decisions about how your assets will be divided, distributed and managed to ensure your loved ones are cared for, but also the management of your assets during your lifetime in the event of your incapacity. It's crucial because it allows you to specify how and to whom your assets should be managed for your benefit and then divided and distributed at your death, potentially reducing estate taxes, and preventing disputes among family members.

Do I Need a Will if I Have a Living Trust?

Even with a living trust, you will still need a will, especially for any assets that were not transferred to the trust during your lifetime. A "Pour-Over Will" will ensure that assets not already in the trust are transferred there upon your death, as the trust will have the instructions of how the assets are to be divided and distributed at your death.

How Can I Avoid Probate?

The best way to avoid probate is by setting up a trust. While a will typically goes through probate, a trust does not. However, to achieve probate avoidance, it's important to ensure that your trust is properly funded prior to your death by titling your assets in the name of the trust.

What is Probate and Is It Only for Large Estates?

Probate is the legal process of validating a will, paying debts and taxes, and distributing assets according to the will. Probate, in one form or another, applies to all wills, regardless of the estate's size, though there are simplified procedures for estates having a value of $50,000 or
less.

How Can I Make Sure My Minor Children Are Cared For?

In your will, you can designate guardians who would take care of your minor children in the event of your death. Additionally, you can set up trusts to manage assets left to minors or incapacitated adults.

What Makes Up a Well-Designed Estate Plan?

A well-designed estate plan should: (i) address the event of an incapacity during your lifetime; (ii) preserve the value of your assets at your death; (iii) reduce taxes and administrative expenses, ensuring your heirs receive what you intended and (iv) protect your privacy.
