What is Estate Planning and Why is it Important?
Proper Estate planning involves not only making decisions about how your assets will be divided, distributed and managed to ensure your loved ones are cared for, but also the management of your assets during your lifetime in the event of your incapacity. It's crucial because it allows you to specify how and to whom your assets should be managed for your benefit and then divided and distributed at your death, potentially reducing estate taxes, and preventing disputes among family members.
Do I Need a Will if I Have a Living Trust?
Even with a living trust, you will still need a will, especially for any assets that were not transferred to the trust during your lifetime. A "Pour-Over Will" will ensure that assets not already in the trust are transferred there upon your death, as the trust will have the instructions of how the assets are to be divided and distributed at your death.
How Can I Avoid Probate?
The best way to avoid probate is by setting up a trust. While a will typically goes through probate, a trust does not. However, to achieve probate avoidance, it's important to ensure that your trust is properly funded prior to your death by titling your assets in the name of the trust.
What is Probate and Is It Only for Large Estates?
Probate is the legal process of validating a will, paying debts and taxes, and distributing assets according to the will. Probate, in one form or another, applies to all wills, regardless of the estate's size, though there are simplified procedures for estates having a value of $50,000 or
less.
How Can I Make Sure My Minor Children Are Cared For?
In your will, you can designate guardians who would take care of your minor children in the event of your death. Additionally, you can set up trusts to manage assets left to minors or incapacitated adults.
